South Orange County SELPA

Capistrano Unified School District:

July 2005, SN05----- v. CUSD: Student is a preschool student with Down's Syndrome. The issue is LRE. Parents and A2Z are seeking placement in the Least Restrictive Environment with appropriate supports and services to facilitate interaction with non-disabled peers. Case settled on first day of hearing. Student received an appropriate placement in a hybrid program to encourage her growth. In addition, she was awarded compensatory education and parents received reimbursements.

Disability: MR (Down syndrome)
Outcome: Female Elementary Student placed by the District into a low functioning class which did not offer reading. Through a settlement agreement District offered an appropriate educational setting that provided for academic supports and NPA services. Parents were reimbursed attorney fees.

Saddleback Valley Unified School District:

July 2005, SN05----- v. SVUSD: Case involves high school student with Autism, and issues include appropriate placement and services. Student is very bright, but due to his deficits arising from his disability, requires the appropriate learning environment in order to make progress. Further, he requires support to address his social / emotional areas of need. Case settled. Student was placed in an unique program wherein he took a train to an alternative school for typical children who had difficulties in a traditional school setting. Parents reimbursed for transportation by the District.

Disability: Autism
Outcome: High Functioning Male High School Student privately placed by Parents in a NPS. In a settlement agreement Parents were reimbursed by the District for the cost of tuition, transportation and attorney fees.
